Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to the hazard of cumulative trauma disorders
as a result of repetitive motion work activities such as, but not
limited to, shingle sawing and trimming, lumber handling, lumber
sawing, and barrel assembly at the shingle mill and specialty mill
because there was no ergonomic program in effect:
a)   Shingle Mill, St. John, Maine - There was no ergonomic
program in effect to detect and minimize or eliminate
repetitive motion illnesses and injuries.
b)   Specialty Mill, Ft. Kent, Maine - There was no ergonomic
program in effect to detect and minimize or eliminate
repetitive motion illnesses and injuries.
Among other methods, one feasible and acceptable abatement method
to correct this hazard is to develop and implement an ergonomic
program which follows the "Ergonomic Program Management Guidelines
for Meatpacking Plants", USDOL-OSHA, 1990
