Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to the hazard of thermal burns from fire:
a.   On or about January 13, 1993, in Spray Area No. 2, the
"downstream" area from the filter was not protected with
a fire suppression system in the event of a fire in the
exhausting area.  Employees sprayed a polyester resin
containing methyl ethyl ketone peroxide, (MEKP), a Class
IC flammable substance, during the manufacture of
fiberglass bathtub enclosures.  One feasible means of
control is to install an approved fire suppression system
within the downstream duct area.
b.   On or about January 13, 1993, in Spray Area No. 1,
filters were not in place to prevent the accumulation
of polyester resin containing MEKP, within the exhaust
duct.  Employees sprayed polyester resin containing MEKP,
a Class IC flammable, during the manufacture of
fiberglass bathtub enclosures.  One feasible means of
control is to install a filter system to remove and/or
catch the spray residue before its entry into the duct
system.
