Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by or crushed from hoist failure: A. BITE PRODUCTION: The overhead hoist, unknown identification had the following deficiencies: 1. The load spreader was not marked with the capacity rating. 2. The hook was rusty and worn out with corrosion. 3. The block was not equipped with tonnage capacity. Among other methods, one feasible and acceptable means to correct the hazard is to: 1. Determine and mark the rated capacity of the spreader. 2. Replace the hook with an appropriate type of hook for the location. 3. Determine the tonnage capacity on the block. B. PIZZA BITE KITCHEN: The CM lodestar monorail overhead hoist had the following deficiencies: 1. The hoisting chain was knotted above the hook. 2. No tonnage capacity on the hoist. Among other methods, one feasible and acceptable means to correct the hazard is to: 1. Perform inspection on the chain sling to determine the lifting capacity on the sling. 2. Install the tonnage capacity on the block. I. Follow the manufacturer's/owner manual recommendations. II. Comply with ANSI/ASME B30.16-1993; Overhead Hoist (Underhung) guidelines for inspections, maintenance, and operations of the overhead hoists. III. Utilize other engineering methods.
