Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free form recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
multiple injuries due to the potential failure of a homemade lifting
device:
A) The homemade lifting beam used to set precast manholes had a
#8 7/8 inch bolt used to replace the shackle pin and a thimble
was not used to form the eye of a wire rope sling.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to adhere to proper rigging practices by using
only the pin supplied with the shackle and place a thimble in the eye
on all wire slings.
