Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a forklift overturning or from the operator falling off the forklift, due to the fact that the operator restraint systems (seat belts) provided on the forklift were not used by the operator. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to require and to effectively enforce the use of the operator restraint systems provided by the manufacturer of the forklift. a) Below decks near the stern ramp: An employee operating a Hyster 60 forklift, serial number H177B10788W was observed not wearing the seat belt provided.
