Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the conditions listed below: W. Silver Recycling, Inc, located at 1720 Magofin, El Paso, Tx for the period of time up to and including September 5, 2001. ANSI B56.1a, section 5.3.19 an active operator protection device or system when provided shall be used. Operators did not utilize the seat belts when operating the forklifts. W. Silver has approximately 20 different fork lifts at this facility. The seat belt is design to reduce the risk of entrapment of the head and torso between the truck and the ground. One feasible abatement method would be to: Enforce the wearing of seat belts at all times the fork lift is in motion and to incorporate seat belt usage in the training program.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the conditions listed below: W.Silver Recycling, Inc, located at 1720 Magofin, El Paso, TX for the period of time up to and including September 5, 2001. Employees using oxy-fuel gas systems to cut metal were exposed to hazards associated with utilizing a grade "R" welding hose in an unapproved manner. Grade "R" hose is to be used only with acetylene gas. The hose on the cutting unit located in the yard was a grade"R" which was attached to a propane cylinder. Compressed Gas Association SB11- 1996 stipulates that only grade "T" hose can be used with Propane. Employees were exposed to hazards associated with use of wrong hose for fuel gas being used.

Silver Recycling, Inc located at 1720 Magofin, El Paso, TX for the period of time up to and including September 5, 2001. The splices on the oxy-fuel gas systems used in the yard were improperly spliced in that screw type hose clamps were used, also there were more than one splice per 50 foot section of hose. Compressed Gas Association Safety Bulletin SB11-1996 stipulates that screw type hose clamps are not recommended and that more than one splice per 50 foot results in unacceptable pressure drop. Employees were exposed to improperly repaired welding equipment.
