Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the conditions listed below: (a) W. Silver Recycling, Inc. located at 1720 Magoffin, in El Paso, Texas for the period of time up to and including 03/15/02. Employees were exposed to driving yard trucks which had no lights, no turn signals, no seat belts, broken windshields, no horn or backup alarms. One feasible method of abatement is to comply with The United States Federal Motor Carrier Safety Standards 49CFR part 396, and North American Standard Vehicle Out-of-Service Criteria 393.9.ia
