Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being pinned under, crushed, or thrown from a forklift truck during an accident with the truck as required in ASME B56.1-1993 and the forklift truck operator's manual: (a)Establishment - An employee was operating a Caterpillar forklift truck, model GP40, serial #10M02116, without wearing the provided seat belt. (b)Establishment - An employee was operating a Caterpillar forklift truck, model 150, serial #13V01215, without wearing the provided seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train employees and ensure employees use the seat belts provided when operating the forklift trucks as referenced in the Caterpillar operations manual and ASME B56.1-1993. ABATEMENT CERTIFICATION REQUIRED
