Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees operated forklifts without utilizing personal restraint devices (seat belts). Among other methods, one feasible and acceptable abatement method to correct the hazard is to ensure proper training and enforcement is provided to all forklift operators regarding the required use of personal restraint devices per national consensus standard ASME B56.1-1993 - Safety Standard for Low Lift and High Lift Trucks. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
