Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(a)On or about February 14, 2002, at 2201 South Street, Racine, WI, the
employer did not require the use of the operator restraint device on the
Mitsubishi Model FB16KT forklift, serial #EFB4B00106, a 1998
Mitsubishi forklift, serial #53035 CLTR, and a Toyota forklift, unknown
serial #, which exposed employees to the hazard of being crushed by the
forklift should it overturn.  The hazard of entrapment of the operator's
head or torso between the forklift and the ground is recognized by the
current consensus standard, ASME/ANSI B56.1a-1989 Addenda to
ASME/ANSI B56.1-1988, and ASME B56.1-1993 Safety Standard for
Low Lift and High Lift Trucks.  Tipover of these forklifts could expose
the employee to being crushed by the forklift or being struck by loads up
to 4,000 pounds.  One feasible and useful method to correct this hazard
is to enforce the use of the operator restraint/seat belt with which these
forklifts are equipped.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
