Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of serious injury as a result of entrapment of the operators body between the forktruck and the ground in the event of a tipover: a)1/30/01, An employee operated a Nissan forktruck (Model#: CUGJ02F35PV, Serial#: D819311), which was equipped with a seatbelt, but was not wearing the protective restraint device (seatbelt). The forktruck was used to transport bins/dumpsters of broken glass. ABATEMENT NOTES: Among other methods, one feasible and acceptable abatement method to correct this hazard is establish a program which requires operators to wear the seatbelts that are provided, as referenced in ASME B56.1-1993 "Safety Standard for Low Lift and High Lift Trucks" and OSHA's New Powered Industrial Truck Operator Training Standard. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM.
