Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 8-15-00 at The Forum Mall, Selma, TX an employee was observed being elevated by the forks of a forklift. The forklift was being used to lower the employee from the truss of the building under construction. The employee was not equipped with a personal fall arrest system and/ or a platform equipped with railing to protect employees from falls was not used. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide employees with a safety platform equipped with standard railing (reference ANSI/ANSI B56.1-1998) to control employees exposure to falls whenever a truck without controls that are elevatable with the lifting carriage or forks is used to elevate personnel.
