General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to unintended actuation of press brakes: Job site, press brake department- Prior to the accident on or about June 26 and during an inspection on or about August 2, 2000, the mechanical foot pedal on the Amada #2 press brake used by employees while cleaning the die and bending metal for doors (respectively) was not provided with a cover (while die cleaning) and when covered, was inadequately covered (while bending metal) to prevent unintended actuation. Employees were exposed to amputation hazards. A feasible and useful means of abatement includes, but is not limited to the following actions: 1) Comply with section 4.2.4.1.4 of the American National Standard Institute's (ANSI) B11.3- 1982, which states that "when a mechanical foot pedal is furnished with the power press brake, a means shall be provided for preventing accidental operation of the power press brake". No abatement certification or documentation is required for this item.
