Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards: (a) Press Brake Department - On or about June 8, 2007, the mechanical foot pedal on the Dreis & Krump mechanical press brake used by employee(s) to bend metal parts was not provided with a guard to prevent unintended actuation. A feasible and useful means of abatement include, but not limited to the following: 1) Comply with Section 6.11.3.1 of the American National Standards Institute's (ANSI) B11.3- 2002, which states that " When provided, foot controls shall be protected to prevent actuation from falling or moving objects, or from unintended actuation. No abatement certification or documentation is required for this item.
