P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of falls from elevated platforms
and/or struck-by crane
structural members:
a)  In the log yard area - Employees were exposed to falls and struck-by
hazards caused by
crane structural collapse due to improper evaluation/repair of structural
defects on the Andritz
Kone Wood Logporter crane.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
1)  Use positive non-destructive evaluations/tests, including but not
limited to, dye penetrant,
magnetic particle and acid etching, to properly determine the extent of
the structural defect
before conducting repair activities.
