Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to to the hazard of delayed rescue and possible injury during entry into, work in, and exit from the space between the ventilation fans bulkhead and shaft W bulkhead: a) Location-CP3(Shaft W-tunnel intersection): On or about March 28, 2001, the employer had not developed and implemented a Confined Space entry procedures that included an attendant to monitor activities in confined/enclosed spaces and initiate immediate rescue response actions. Among other methods, feasible means of abatement would be to instite a confined space entry program meeting the requirements of ANSI Z117.1. The program should include: 1) Hazard identification procedures or process before work is conducted in the space. 2) Hazard evaluation or analysis. 3) Effective training of the authorized entrants, attendants, and all affected employees.
