Section 5(a) (1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment or a place of employment which was free from recognized
hazards in that
employees were exposed to having their head and torso entrapped between
the truck and ground
in event of tip over:
Warehouse - seat belts, where provided on powered industrial trucks, were
not used as
required by the ANSI B56.1 consensus standard for powered industrial
trucks.
Among feasible methods to abate this hazard is to comply with American
National
Standard Institute(ANSI) B56.1c-1991 addenda to ANSI B56.1-1988 Safety
Standard for
Low Lift and High Lift Trucks.
