Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling loads: a.Site - The capacity of an aluminum lifting beam (suspended from a crane) had not been checked to ensure that it could withstand the loads it was being used to lift and marked with the rated capacity. b.Site - The capacity of a set of forks (suspended from a crane) which were being used to lift materials had not been checked to ensure that it could withstand the loads it was being used to lift and marked with the rated capacity. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement would be to determine the safe working loads of the equipment and mark the equipment with the values. NEW ENGLAND HOMES, INC. WAS PREVIOUSLY NOTIFIED OF THIS HAZARD IN A LETTER DATED SEPTEMBER 29, 1999 AS A RESULT OF OSHA INSPECTION NUMBER 302535018, WITH RESPECT TO THE WORKPLACE LOCATED AT 270 OCEAN ROAD, GREENLAND, NH.ENLAND,
