Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY A FALLING OBJECT : a)1984 Kenworth truck, company #76, on or about 9/5/01: Cable and hook container loading device used by employees to lift and dump plastic trash totes had the throat latch missing from the hook. b)1997 Freightliner truck, company #25, on or about 9/5/01: Cable and hook container loading device used by employees to lift and dump plastic trash totes had the throat latch missing from the hook. ABATEMENT NOTE: Ensure that mobile refuse collecting and compacting equipment is being properly maintained per American National Standard ANSI Z245.1 -1984, Section 6.1 and American National Standard ASME B30.10-1993, Section 10-1.2.3(c).
