Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The
employer did not furnish
a place of employment which was free from recognized hazards in that
employees were exposed
to struck by hazards by the use of hydraulic lifts that did not have a
load holding device.
The forklift jack did not have a load holding device in the event of
hydraulic failure.
Among feasible and acceptable abatement is to comply with the Safety
Requirements for
Construction, Testing and Validation of Automotive Lifts, ANSI/ALI ALCTV
-1998 and
provide a load holding device that incorporates a mechanical device to
prevent downward
movement of more than six inches after stopping motion. Function shall
begin within 24
inches of rise and continue to the full rise position.
