Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employee(s) were exposed to the hazard of amputation: (a)Bay 2; Pacific Press Brake #2: On April 2, 2003, two persons were required to operate the Pacific Mechanical Press Brake #2 to bend or form a large piece of metal. The press brake was operated by one foot control (pedal) which exposed employees to the hazard of hand/finger amputations. Among others, one feasible and acceptable means of abatement would be to follow the recommendations of the American National Standards Institute, ANSI B11.3-1982, Safety Requirements for Construction, Care and Use of Power Press Brakes, Section E6.1.4., Safe Guarding the Point of Operation. Paragraph E6.1.4.2.6 (3), Additional Hostage Controls, states that, "In a piece-part bending operation requiring more than one operator (helper), separate hostage controls shall be provided for each (operator) helper." OR IN THE ALTERNATIVE 29 CFR 1910.212 (a)(3)(ii): The point of operation on machines whose operation exposed employees to injury was not guarded: a)Bay 2; Pacific Press Brake #2: Separate controls or other appropriate guarding devices were not provided for both of the employees operating the press to ensure that their hands and fingers were clear of the point of operation prior to and during operation of the press.
