Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following condition(s): a) Employees were exposed to the recognized hazard of being struck by large industrial motor vehicles with obstructed views when vehicles were operated at the loading dock and in the material yard. Among other methods to correct the hazard one means is to maintain the back-up alarms that are installed on the vehicles. A second method could be to use signalman when backing-up.
