Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF FALLING TO A LOWER LEVEL: a)Commissary Building, Small Freezer, on or about 3/12/03: (1) 6-foot fiberglass stepladder provided as a means to access upper storage rack level had a defective spreader / locking device on both sides, making the spreader / locking device inoperative. ABATEMENT NOTE: Ensure that ladders are inspected periodically preferrably before use. Working parts and connections are to be checked, where structural damage is found the ladder is to be taken out of service, per American National Standard, ANSI A14.5a-1985, Section 9.4.1.
