Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to operating equipment with defective brakes: (a)On 04Aug. 2003, and at times prior thereto, the employer exposed employees to serious physical harm by having them operate a Case front end Loader Model W14FL, S/N 9137734 that did not have brakes capable of stopping and holding the equipment. Among other methods, one feasible and acceptable abatement method to correct this hazard is to have the brakes repaired to original equipment manufacturers specifications. Note: Abatement certification required for this item.
