Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to urinary tract infections, abdominal pains, etc due to the lack of available toilet facilities: (a)Bowen Farm - Toilet facilities were not provided during the period November 20, 2004 thru January 20, 2005 for the chicken catching crew. Among other methods, one feasible and acceptable abatement methods to correct this hazard includes but not limited to: (1)Providing portable toilet facilities for the chicken catching crews.
