North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to: explosion and fire hazards.
a)facility, production area, on October 8, 2003, a
densifier being used to process polyethylene foam for
recycling purposes sparked an explosion in which an
operator died as a result of injuries sustained from the
explosion. Adequate precautions were not taken by the
employer to prevent the release of flammable gases during
polyethylene foam densification processing nor were
ignition sources controlled.
Among other methods, feasible and acceptable abatement
methods to correct this hazard are:
1)Ensure all raw material (e.g. polyethylene
foam) is sufficiently pre-processed to remove
all isobutane or other flammable gasses prior
to placement in the densifier.
2)Provide sufficient ventilation to the
densifier to ensure flammable vapor
concentrations do not exceed the lower
flammable limits.
3)Eliminate all possible sources of ignition in
the densifier, including static electricity.
