North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from falling materials: a)manufacturing area, the air separator and hoist system was designed and installed using materials that were not sufficient to support the weight. Feasible and acceptable abatement methods to correct this hazard includes, but is limited to: 1)Ensure the separator and hoist system is designed and installed under the direction of a Registered Professional Engineer.
