North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a structural collapse of the building: a)in the production facility - where a 20 foot section of a wooden, roof support beam adjacent to the employees bathrooms was observed with damage from water, fire and age to the point where the roof was being held up with a stack of approximately 35 wooden 4x4 pallets. ABATEMENT NOTE: The employer can reasonably abate this hazard by contracting with a structural engineer to examine the building and develop a repair plan to replace the damaged beam and any other areas that are deemed unsafe by the engineer, and then to execute the approved repair plan(s).
