General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: a) Ennis, Incorporated dba Ennis Leipsic - Leipsic, Ohio: On or about August 11, 2005 the employer failed to ensure that the below- the-hook lifting device used to put rolls of paper onto the collator on Line 702 was load tested following modifications made by the employer and marked with the rated load capacity of the device. Abatement Note: One feasible abatement method is to comply with ANSI/ASME B30.20a-1987 "Below-the-Hook Lifting Devices" Section 20- 1.4.2 which requires that lifting devices be tested and inspected prior to use after an altercation or modification of the device, and that a report be prepared confirming the load rating. The load must also be marked on the lifting device per Section 20-1.2.1. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
