Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
to each of his employees employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazard of being struck by
vehicles:
On or about August 18, 2004, three employees were exposed to the hazard of
being struck by
vehicles while working in the street and by the crane within the
construction zone.
A feasible and useful means of abatement includes, but is not limited to
the following methods:
1) Make sure employees are wearing "High Visibility Clothing" or a
reflective/retroreflective
Traffic Vest as recommended by the American National Standard Institute 2)
Institute a means
of communication between the spotter and the equipment operator to
ascertain the position of
the spotter, ie. radio 3) Train employees to recognize the importance of
wearing high-visibility
clothing and reflective vests and enforce company safety rules that
require employees to wear
such clothing.
PLEASE NOTE:  CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS
REQUIRED FOR THIS VIOLATION.
