Nevada Revised Statute 618.375(1):  The employer did not furnish
employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees in that:
The employer did not ensure that the employees were not exposed to a fall
hazard, as follows:
a.The employees were not using personal fall resistant equipment in such a
matter
to be protected from a elevated fall when exiting the guardrail protected
aerial
platform lift (JLG Gradall, Commander, Model#: CM-20M and Serial#:
0200005941).  The employees used planking atop the toprail of the guardrail
system to exit the aerial platform lift.  The platform lift was positioned
at the
southeast corner of the casino front entrance, adjacent to the front door
of the gift
shop.  The employees were exposed to a fall hazard of approximately 15
feet at
the unprotected canopy/roof level.

instructed in the safe and proper operation of the aerial device in
accordance with
the manufacturer's operating manual: (JLG Gradall, Section 1-6. Operations:
Never position ladders, steps or similar items on the unit to provide
additional
reach for any purpose and do not extend reach limits of this machine with
additional equipment such as planks, boxes, etc.
One feasible and acceptable method of abatement, among others, would be to
ensure that all users of the aerial platform lift are trained and
instructed relating
to proper use and fall protection.
