Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being cut by the blade of the hand held portable cutting-off machine. a).On or about 08/31/05 - at 28-11 QueensPlaza North LIC An employee was cutting a member of the supporting system at the bottom of the trench using a portable cut off saw improperly when the saw kicked back injuring employee. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Develop and implement a training program specifically addressing safe operating procedures for hand held portable cutting-off machine, as stipulated in the manufacturer's manual. The employer must ensure that these procedures are followed. WRITTEN ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
