Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were operating forklift trucks without wearing the seat belt exposing them to potential crushing injuries. Establishment: Employees were not required to wear seatbelts while operating forklift trucks. One method to correct the condition is to establish a work rule, train the employees to wear the seatbelts, and enforce the use of the seatbelts.
