Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of ultraviolet radiation exposure from a Class IV laser: a) Production Area - Employees, Laser Operator and other machine operators in the area were exposed to hazards of an improperly contained class IV laser cutting machine used to cut steel on or about November 1, 2005. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement. Among other method, one feasible abatement method would be to install all safety cabinet panels and interlocks which would reduce the laser hazards to that of a class 1 laser . A second feasible abatement method would be to institute a laser safety program as described in the American National Standard of Safe Use of Lasers Z136.1 2000. Such a safety program would include designating a laser safety officer to oversee safety for all operating, maintenance and servicing situations; training employees regarding the hazards of laser light exposure; Calculating a nominal hazard zone for the laser; implementation of a medical surveillance and establishing a class 4 laser controlled area using the information from the calculations of the nominal hazard zone.
