Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Production/Finishing Department - The Abaco below the hook lifting device (mechanical grip device) was not marked with the proper rated load with a nameplate or tag that also addresses the manufacturer of the device, serial number and lifter weight as prescribe by the ASME An American National Standard for Below-The-Hook Lifting Devices, B30.20-2003, Section 20- 1.2.1 that the below the hook lifting device be properly marked with the rated load, lifter weight, manufacturer name and serial number to prevent the device from being overloaded. Employees were observed using the below the hook device on March 25, 2005. No abatement certification or documentation is required for this item.
