Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-between and struck-by hazards: a)Diamond Contracting, Corp. & 58.5 East 128th Ave. in Thornton, CO: The employer did not ensure employees were protected from caught-between and struck-by hazards in that employees were permitted to ride the superstructure of the Komatsu PC220LC track-hoe excavator. This condition exposed employees to caught-between and struck-by hazards. As instructed in the Safety Manual for Operating and Maintenance Personnel published by the Association of Equipment Manufacturers: "Warning: Your hydraulic excavator is a one- person machine.
