Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a. On the site, employee was observed riding the fork of a Skytrak forklift #10042 in order to gain access to the canopy roof area. The employee was going onto the roof area in order to brick up and existing window. Among the feasible means of abatement that can be used to correct this are: Utilize only platforms designed for use in elevating personnel with forklifts. These must meet the requirement set forth in ANSI/ASME B56.6-2002.
