Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)On or about April 3, 2006, and at times prior, employees in the waste water treatment area of the plant were exposed to fall hazards where the fiberglass stepladder used to check the overflow tanks was used as a single ladder without being fully extended and the spreaders not locked in place. Among other methods, one feasible and acceptable method to correct this hazard is to train or re-train employees in the correct and proper use of step ladders. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
