Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential combustible dust explosion: On August 26, 2008, at and around the Re-Grind and Flour Rooms, employees were exposed to potential combustible dust deflagration due to: (1) the existing dust collector was installed inside and lacked recognized controls (e.g. suppression, inerting, venting, etc.) required for safe operation, (2) pneumatic piping lacked adequate bonding and grounding measures including a procedure for testing continuity, and (3) there were no controls of electrical ignition sources during housekeeping. Among other methods, one feasible and acceptable abatement method to correct the hazardous conditions would be adherence to the safe design, installation, and operation of agricultural dust systems as described in NFPA 61 Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities - 2008 Edition. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
