Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to impalement hazards: a)Construction site at Mobile Regional Airport, Mobile, Al (security gate roof area, walkway roof area, and gate roof area): While removing and installing new roofing material on a flat roof the employer had left 12-inch protruding lightning rods in place around the edge of all edges and down the centerline of the one roof area. This exposed employees to impalement hazards as they worked near and around the lightning rods while removing and installing roofing material. Feasible means of abatement would be to install protection caps on the exposed ends or have the rods temporarily removed.
