Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing or other hazards associated with employees not being restrained in the forklift in case of tipping or a rollover: Location: Buckley Street, Stoughton, MA On June 6, 2006, the operator of the Moffett M50 truck mounted forklift (SN E090278) was not wearing his seatbelt as he was picking up pallets of HardiPlank at a construction site. As a result, when the forklift tipped forward under a load, he was thrown from his seat and injured his head on the forklift cage. Among other methods, one feasible and acceptable method to correct this hazard would be to 1) Retrain forklift operators to utilize seatbelts during forklift use; 2) Monitor employees to assure compliance; and 3) Enforce company policy, requirements in ASME/ANSI B56.1-2000 "Safety Standard for Low Lift and High Lift Trucks", and Moffett operation manual requirements for the use of seatbelts while operating forklifts.
