Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fire and explosion. On or about May 16, 2008, at a work place located at the 600 block of Fenet Street, McKinney, Texas 75069, employees were allowed to use a Directional Drill Rig to install a new gas line, where the location of an existing gas line had not been marked. Among the feasible methods to prevent this hazard is to mark existing gas lines with a highly visible paint and place flags warning of the existence of a gas line prior to starting boring operations.
