Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by vehicles (a) On or about 26 January 2007, a concrete pump truck was operated by a driver who was not certified to drive the pump truck and operate concrete pump truck without a spotter, exposing employees to a hazard of being struck by moving equipment. Among other methods, feasible and useful, one feasible method of abatement would be to ensure the driver uses a spotter or a back-up alarm. Ensure horn and lights are operational and employee are trained on the use of pump truck and backing-up procedures.
