Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were being exposed to crushing hazards from the rear dual wheels of a
tractor:
a.On or about January 24, 2008, an employee by-passed the ignition switch
of the
tractor by jump-starting it from outside of the cab through the starter
solenoid,
exposing himself to being struck or crushed by the rear dual wheels of the
tractor.
b.On or about January 25, 2008, an employee by-passed the ignition switch
of the
tractor by jump-starting it from outside of the cab through the starter
solenoid,
exposing himself to being struck or crushed by the rear dual wheels of the
tractor.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard was to train employees (and enforce the training) regarding the
requirements of the tractor operator's manual which states, in part:
"Start engine
only from operator's seat" and "do not connect or short across terminals on
starter solenoid".
