North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazard from high concentrations of airborne wood dust: a)facility, forming area - where employees were allowed to work in a Class II Division II location where wood dust had accumulated 1/2 inch to 2 inches deep on all the flat surfaces throughout the area. One feasible and acceptable abatement method, among other, to correct this hazard is to have regular cleaning frequencies established for walls, floors, and horizontal surfaces, such as equipment pipes, hoods, ledges, beams, and above suspended ceilings and other concealed surfaces, to minimize dust accumulation within operating areas of the facility.
