Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of tipping the Gehl Model RS8 Telehandler (Rough Terrain Forklift). Employees were allowed to perform steel erection operations while standing on a work platform that was lifted by a rough terrain forklift. The work platform extended a total of fourteen (14) feet beyond the load backrest. Among other methods, one feasible and acceptable abatement method to correct this hazard is to construct and use the work platform in accordance with Paragraphs 8.24.1(b) and 5-15.1(t) of the American Society of Mechanical Engineers (ASME) B56.6-2002, Safety Standards for Rough Terrain Forklift Trucks. R.K. Wallace Construction Inc dba Wallace Steel Erectors was previously cited for a violation of this Occupational Safety and Health Standard which was contained in OSHA Inspection No. 307595165, Citation No. 01, Item No. 001 issued on 09/15/2004, with respect to a workplace located at 4405 Hwy 190 Service Rd, Covington, Louisiana and became a Final Order on 05/31/2005. DISCLAIMERS: 1) You are not limited to the abatement methods suggested above. 2) The methods explained are general and may not be effective in all cases. 3) The employer is responsible for selecting and carrying out an appropriate method.
