Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of potentially fatal burns from the release of highly pressurized water and other chemicals at 210 degrees fahrenheit during dye operations. a) Dye House: Employees operating the dye tank were exposed to hazard of potentially fatal burns due to installation of a second gasket in the area where the drum meets the cylinder, in an attempt to ensure a tight seal where steam is released into tank. Violation observed on or about 11/14/2006. Among other methods, feasible and acceptable abatement methods to correct this hazard includes: 1) install a splash guard on the dye tank to protect employees from the spray of any future releases; 2) develop a documented preventative maintenance program which provides for regular inspections and replacement of all gaskets and pressure relief devices; 3) installing temperature and pressure switches in line with the dye tank so that the lid cannot be opened unless you are within the appropriate temperature and pressure ranges; 4) Follow the guidelines and specifications of the gasket manufacturer; and 5) provide training for all operators in the proper operating and inspection procedures.
