Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to chemical vapors, mist and vigorous exothermic reaction from incompatible chemicals. a) Indoors, near Tonnelle Avenue Loading Platform 55 gallon drums of incompatible chemicals (50hydrogen peroxide and 56 acetic acid) were stored next to and on top of each other, along an aisleway where they could be knocked over or punctured with a forklift, causing a hazardous reaction. Violation observed on or about 10/3/08. Among other methods, one feasible and acceptable abatement method to correct this hazard is to store drums away from busy aisleways, separating chemicals that would react if mixed together.
