Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to a possible entrapment of the
head and torso between a forklift and the ground or other surface while
operating forklifts should a tip-over of
the forklift occur.  One feasible and acceptable abatement method  to
correct this hazard is to use the operator
protection device seat belt provided on the forklift.
DOCK AREA:  SEVEN CATERPILLAR FORKLIFTS CONTAINED SEATBELTS THAT WERE
FASTENED AROUND BEHIND THE OPERATOR'S SEAT, AND WERE NOT USED BY EMPLOYEES
OPERATING FORKLIFTS.
