Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to possible entrapment of the head and torso between the high lift truck and the floor or other surface while operating the Hyster CO1 Model E40B forklift with clamp attachment should a tip-over of the forklift occur. One feasible and acceptable abatement method to correct the hazard is to provide the forklift with an operator restraint device (seatbelt), system or enclosure that will reduce the risk of such entrapment: BATTERY ROOM: THE HYSTER CO1, MODEL E40B FORKLIFT WITH CLAMP, SER B108B11032E, LACKED AN OPERATOR RESTRAINT DEVICE.NT
